Ohio Ballot Board : Proposed Constitutional Amendment Regarding Clean Energy

 
 
 

Description

As required by Ohio law, the Ballot Board met to determine whether a proposed constitutional amendment regarding clean energy consists of more than one amendment. The Ballot Board has 10 days from the date the certification is received from the attorney general to complete this task.

Secretary of State Jon Husted serves as chair of the Ohio Ballot Board and oversees the board’s proceedings. Other members of the Ballot Board include: Fred Strahorn, Vice Chair; State Senator Keith Faber; Mark Griffin; and William N. Morgan. Ballot Board meetings are open to the public.

I AM JOHN HUSTED, OHIO SECRETARY OF STATE AND CHAIR PERSON AND IF
THERE IS NO OBJECTION FROM BOARD MEMBERS I WOULD LIKE TO ASK THE
CHIEF COUNSEL BUT SEE SCHUSTER TO SERVE AS SECRETARY THIS
AFTERNOON. A RECORD OF THESE PROCEEDINGS IS
BEING TRANSFORMED BY A COURT REPORTER AND THE OHIO CHANNEL IS
STRAINING THIS MEETING LIVE ON THEIR WEB SITE, WHERE IT WILL BE

QUORUM. TODAY THE BALLOT BOARD MUST
EXAMINE THE CLEAN ENERGY PROPOSED CONSTITUTIONAL
AMENDMENT TO DETERMINE WHETHER IT CONTAINS ONLY ONE PROPOSED
CONSTITUTIONAL AMENDMENT. IF THE BOARD DETERMINES IT
CONTAINS MORE THAN ONE THE BOARD MUST PROVIDE THE PROPOSED
CONSTITUTIONAL AMENDMENT INTO INDIVIDUAL AMENDMENTS.
THE PROPOSED CONSTITUTIONAL AMENDMENT TEXT AND SUMMERY WERE
READ -- PROVIDED TO BOARD MEMBERS IN ADVANCE OF THE
MEETINGS AND ARE IN THE BOARD MEMBERS NOTEBOOKS.

AT THIS POINT IN TIME, WE WILL MOVE TO THE PUBLIC COMMENTS
SECTION. IF ANYONE RUSHES -- WISHES TO
ADDRESS THE BOARD WHETHER IT IS ONE AMENDMENT, PLEASE SIGN IN ON

AND AGAIN, AS I ALWAYS REMIND, WE ARE NOT HERE TO DEBATE THE
MERITS OF THE PROPOSAL BUT WHETHER IT IS ONE AMENDMENT OR
MORE. AT THIS POINT IN TIME, I WOULD
LIKE TO ASK MR. DON MCTIGUE TO COME FORWARD AND PROVIDE, --
PUBLIC COMMENT.

MEMBERS OF THE BOARD. I AM DONALD MCTIGUE, AND
REPRESENT THE FOUR COMMITTEE MEMBERS OF THE PETITION
COMMITTEE AS LISTED ON THE FACE OF THE PETITION.
AS A SECRETARY HUSTED SAID, THE ONLY ISSUE TODAY IS WHETHER OR
NOT THE PROPOSAL CONSTITUTES ONE AMENDMENT TO THE CONSTITUTIONAL
MORE THAN ONE. I RESPECTFULLY SUBMIT THAT IT
CLEARLY IS JUST ONE AMENDMENT. IT IS A BOND ISSUE THAT
INCLUDES PROVISIONS RELATED TO AMOUNT AND PURPOSES, AND
DECISION MAKING OVER DISTRIBUTION OF THE PROCEEDS OF
THE BOND. IT IS ALL, I THINK, IN TERMS OF
THE AMENDMENTS, IT ALL FITS VERY EASILY WITHIN THE STANDARD
ANNOUNCED BY THE SUPREME COURT IN THE OHIO LIBERTY CASE, IN
THAT THE BALLOT BOARD HAS A OBLIGATION TO LIBERALLY
CONSTRUED THE RIGHT OF INITIATIVE, AND AS LONG AS THE
PROPOSAL, THE PROPOSED AMENDMENT, THERE IS SOME
REASONABLE RELATIONSHIP TO A SINGLE GENERAL OBJECT OR GENERAL
PURPOSE, THEN IT IS ONE AMENDMENT.
SO, WHAT WE HAVE IN THIS AMENDMENT ARE ESSENTIALLY
PROVISIONS AUTHORIZING THE BONDS AND THEN PROVISIONS ON
IMPLEMENTING THE BONDS. CLEARLY ALL ONE PURPOSE.
